1. Introduction
Welcome to Softnixx ("the App"). These Terms and Conditions ("Terms") govern your use of our mobile application and services that enable the purchase of data bundles and airtime. By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

Data and airtime purchase services provided through the App
"Account"
Your registered account with the App
"Wallet"
Virtual wallet within your Account for storing funds
You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years old.
3.2 Legal Capacity
You represent that you have the legal capacity to enter into binding contracts and are not barred from using the App under applicable laws.
4. Account Registration
4.1 Account Creation
To use our Services, you must create an Account by providing:
Valid email address
Active phone number
Accurate personal information
Secure password
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activities that occur under your Account
Notify us immediately of any unauthorized use of your Account
We reserve the right to suspend or terminate accounts suspected of unauthorized use
4.3 Account Verification
We may require verification of your identity and phone number before processing transactions to prevent fraud.
5. Wallet and Payments
5.1 Wallet Funding
You can fund your wallet using various payment methods (debit cards, bank transfers, USSD)
Funds credited to your wallet are non-refundable except as provided in Section 7
Minimum wallet funding: ₦100 | Maximum wallet balance: ₦1,000,000
5.2 Transaction Processing
All transactions are final once processed
Data and airtime are delivered instantly in most cases
Delivery times may vary based on network provider systems (typically 1-5 minutes)
Transaction receipts are available in your transaction history
5.3 Pricing
Prices are displayed in Nigerian Naira (₦) and are subject to change without notice
You will be charged the price displayed at the time of transaction
Discounts and promotions may apply at our discretion
6. Data and Airtime Services
6.1 Service Availability
We act as a reseller of network provider services (MTN, Glo, Airtel, 9mobile)
Service availability depends on network provider infrastructure
We are not responsible for network provider service quality, network coverage, or technical issues
6.2 Data Bundles
Data bundles are subject to network provider terms and conditions
Unused data may expire according to network provider policies (typically 30 days)
Data speed and quality depend on network coverage and congestion
All data purchases are non-refundable once delivered
6.3 Airtime Recharge
Airtime recharges are processed instantly
Airtime has no expiration date unless specified by network provider
Airtime cannot be converted back to cash
Minimum airtime recharge: ₦50 | Maximum: ₦50,000 per transaction
7. Refund and Cancellation Policy
7.1 Failed Transactions
If a transaction fails and your wallet is debited, funds will be automatically refunded to your wallet within 24-48 hours.
7.2 Wrong Recipient
We are not responsible for transactions sent to wrong phone numbers. Always verify recipient details before confirming transactions.
7.3 Refund Eligibility
Refunds are only processed for:
Failed transactions that were not auto-refunded
Duplicate transactions
Technical errors on our platform
7.4 Refund Processing Time
Approved refunds are processed within 3-5 business days and credited to your wallet or original payment method.
8. User Obligations
You agree not to:
Use the App for any illegal purposes
Attempt to gain unauthorized access to our systems
Use the App to commit fraud or other illegal activities
Reverse engineer or modify the App
Use automated means to access the App
Provide false or misleading information
Engage in any activity that disrupts or interferes with the App
9. Limitation of Liability
To the maximum extent permitted by law:
We provide the App and Services "as is" without warranties of any kind
We are not liable for indirect, incidental, or consequential damages
Our total liability shall not exceed the amount you paid for the specific transaction giving rise to the claim
We are not responsible for network provider issues, delays, or service quality
We are not liable for any losses resulting from unauthorized access to your account
10. Intellectual Property
The App, including its code, design, logo, and content, is owned by Softnixx
You may not copy, modify, distribute, or create derivative works without written permission
All trademarks, service marks, and logos are property of their respective owners
Unauthorized use of any intellectual property is strictly prohibited
11. Privacy and Data Protection
We collect and process personal data as described in our Privacy Policy
We implement industry-standard security measures to protect your data
We do not share your data with third parties except as necessary for service delivery
You have rights to access, correct, and delete your personal data
Transaction data is retained for 7 years for regulatory compliance
12. Termination
We may suspend or terminate your account immediately without prior notice for:
Violation of these Terms
Fraudulent or illegal activities
Non-payment or chargebacks
Request by law enforcement or government agencies
You may terminate your account by contacting customer support. Upon termination, your wallet balance will be refunded after deducting applicable fees (₦100 processing fee).
If issues cannot be resolved through customer support within 14 days, parties agree to mediate in good faith through a mutually agreed mediator.
13.3 Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal actions shall be brought exclusively in the courts of Lagos State, Nigeria.
14. Changes to Terms
We may modify these Terms at any time without prior notice
Continued use of the App after changes constitutes acceptance of modified Terms
We will notify you of material changes via email or App notification at least 7 days in advance
The current version of Terms will always be available in the App
